These Terms of Service (“Terms”) govern your access to and use of the website and services  (the “Website”) provided by AIP Living LLC DBA Aging In Place ADU (“Company,” “we,” “us,” or “our”). These Terms apply only to users located in the United States.

By using the Website or services, you accept and agree to be bound by these Terms and all applicable policies referenced herein, including our Privacy Policy available at aipliving.org. Your continued use of the Website constitutes ongoing acceptance of any updates to these Terms.

 2. User Eligibility

To use the Website or services, you must be at least 18 years old and have the legal capacity to enter into a binding contract. If you are under 18, parental or guardian consent is required.

3. Services Provided

AIP Living LLC dba Aging In Place ADU provides planning, design, and permitting services for Accessory Dwelling Units (ADUs) and aging-in-place home modifications, serving homeowners in Los Angeles and Orange County, California.

Our services include:

  • Pre-designed ADU plan packages
  • Custom ADU and home design services
  • Feasibility evaluations and property assessments
  • Educational consultations and project guidance
  • Permitting coordination and city submittal support
  • Existing home aging-in-place modifications (planning and design)

We are a planning, design, and permitting firm. We do not perform construction services and are not a general contractor. Nothing on the Website constitutes a guarantee of permit approval, project timeline, or construction outcome. Results vary based on property conditions, local jurisdiction requirements, and factors outside our control.

You agree to use the Website and services only for lawful purposes and in compliance with these Terms and applicable laws. 

4. No Construction Services

Our scope of work is limited to planning, design, and permitting. We do not build, construct, or supervise construction. Any contractor referrals we provide are made as a courtesy and do not constitute an endorsement or guarantee of that contractor’s work, licensing, or performance. You are responsible for independently vetting and contracting with any builder or trade professional.

5. Consultations and Project Engagements

Initial consultations may be offered at no charge and are intended to help you understand your options. Paid engagements are governed by a separate written agreement or service proposal that specifies scope, deliverables, fees, and timelines. In the event of any conflict between these Terms and a signed service agreement, the service agreement controls.

 6. User Obligations and Restrictions

By using the Website, you agree to:

  • Provide accurate and complete information when submitting inquiries, forms, or scheduling requests
  • Use the Website only for lawful purposes
  • Not copy, reproduce, or redistribute our plan designs, documents, or proprietary materials without written permission
  • Not use automated tools, bots, or scrapers to access the Website without prior written consent
  • Not attempt to gain unauthorized access to any portion of the Website or its underlying systems
  • Not submit false, misleading, or fraudulent information

We reserve the right to refuse service or terminate access to anyone who violates these obligations or engages in conduct we determine to be harmful, abusive, or contrary to applicable law.

7. Fees and Payment

Fees for our services are determined based on the scope of your project and are provided to you in a written service proposal or agreement prior to engagement. All fees are in U.S. dollars.

By agreeing to a service proposal and proceeding with payment, you authorize us or our designated payment processor to charge the amount outlined in that agreement. Payment terms, refund eligibility, and any cancellation provisions are specified in the applicable service agreement.

We reserve the right to update our fee structure at any time. Changes will not affect engagements already confirmed in a signed agreement.

8. Intellectual Property

All content on the Website including plan designs, written materials, branding, graphics, logos, and documentation is owned by AIP Living LLC dba Aging In Place ADU or its licensors and is protected by U.S. copyright, trademark, and intellectual property law.

When you purchase a pre-designed plan package, you receive a limited, non-exclusive license to use those plans for a single permitted project at a single property. You may not resell, share, sublicense, or reuse the plans for additional projects without a separate written agreement.

 Unauthorized copying, reproduction, modification, or distribution of any Website content or plan materials is strictly prohibited.

 9. Third-Party Links and Partners

The Website contains links to third-party websites. We are not responsible for the content, accuracy, privacy practices, or services of those third parties. Links are provided for convenience only and do not constitute an endorsement.

 If you engage with a third-party partner through our referral network, that relationship is governed by the terms of the third party. We are not a party to those agreements and bear no liability for their performance.

10. Privacy Policy

Your use of the Website and services is also governed by our Privacy Policy, available at aipliving.org. The Privacy Policy explains how we collect, use, and protect your personal information, including how we handle SMS opt-in data and marketing communications. By using the Website, you consent to the data practices described therein.

For matters outside our scope, we recommend consulting the appropriate licensed professional.

We do not guarantee that any ADU or home modification project will receive permit approval or meet any particular timeline, as these outcomes depend on factors beyond our control, including local jurisdiction processing times and property-specific conditions.

12. Limitation of Liability

To the fullest extent permitted by applicable law, AIP Living LLC dba Aging In Place ADU, its officers, employees, and partners will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

  • Reliance on information provided on the Website
  • Delays or denials in the permitting or approval process
  • Acts or omissions of third-party contractors or referral partners
  • Any errors in plan documents resulting from inaccurate property information provided by you

Our total liability for any claim arising out of or related to these Terms or our services will not exceed the amount you paid us for the specific service giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless AIP Living LLC dba Aging In Place ADU, its officers, employees, affiliates, and partners from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising from:

  • Your provision of inaccurate or incomplete property or project information

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Los Angeles County, California.

Before initiating any legal action, both parties agree to attempt in good faith to resolve disputes informally by contacting us at hello@aipliving.org. We will make reasonable efforts to respond and resolve the matter within 30 days.

15. Termination

We may suspend or terminate your access to the Website or services at any time, with or without notice, if we determine that you have violated these Terms or engaged in conduct harmful to us, other users, or third parties. Upon termination, all licenses granted to you under these Terms immediately cease.

Provisions that by their nature should survive termination including intellectual property rights, disclaimers, limitation of liability, indemnification, and governing law will remain in effect.

16. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we do, we will post the revised Terms on this page with an updated Effective Date. Continued use of the Website or services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
